These Terms of Service (“Terms”) govern your use of Best in Gaya websites and apps (including Best In Gya). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

Best in Gaya provides a local directory, discovery, listing, enquiry, and related tools for businesses and users in Gaya and nearby areas. Features may change, and some features may require an account or paid plan.

2. Accounts

• You must provide accurate registration information and keep it updated.
• You are responsible for activity under your account and for keeping OTP/passwords confidential.
• We may suspend or terminate accounts that violate these Terms, harm other users, or create legal risk.

3. Business listings & content

• Business owners are responsible for the accuracy of their listing information, prices, photos, and offers.
• You must only upload content you have rights to use. No illegal, misleading, defamatory, or infringing content.
• We may edit, hide, or remove content that violates these Terms or applicable law.
• User reviews must be honest and based on genuine experience.

4. Enquiries, bookings & marketplace

When you contact a business or place an order/booking through the Service, you enter a relationship with that business. Best in Gaya is a platform; unless we explicitly state otherwise, we are not the seller of goods/services listed by third parties and are not responsible for fulfilment quality, except as required by law or a separate written commitment.

5. Payments & subscriptions

Paid plans (e.g. business subscriptions, promotions) are billed as shown at checkout. Refunds are governed by our Refund Policy. Taxes may apply. Failure to pay may result in loss of paid features.

6. Acceptable use

You agree not to:

• Scrape, spam, or abuse the Service or other users;
• Attempt unauthorised access to systems or other accounts;
• Upload malware or interfere with Service operation;
• Use the Service for illegal activity or to impersonate others.

7. Intellectual property

Best in Gaya branding, software, and site design are owned by us or our licensors. Listing content remains owned by the respective owners, with a licence to us to host and display it for the Service.

8. Disclaimers

The Service is provided “as is”. We do not guarantee uninterrupted availability, or that every listing is complete or error-free. Always verify critical details (hours, prices, availability) with the business before relying on them.

9. Limitation of liability

To the maximum extent permitted by law, Best in Gaya and its operators are not liable for indirect, incidental, or consequential damages, or for losses arising from third-party businesses, user content, or events outside our reasonable control. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 3 months before the claim (or INR 1,000 if you paid nothing).

10. Termination

You may stop using the Service and request account deletion at any time (see Privacy Policy). We may stop providing the Service or terminate access where reasonably necessary.

11. Governing law

These Terms are governed by the laws of India. Courts in Gaya / Bihar (or as otherwise required by mandatory law) shall have jurisdiction, subject to applicable consumer protections.
